Terms of service
Eco-friendly lawn care:
Weekly lawn maintenance is performed every 7-9 days depending on the weather. Bi-weekly lawn maintenance is performed every 13-15 days depending on the weather. Maintenance includes string trimming and edging, mowing, and clearing clippings and debris from all hard surfaces using a blower. Our equipment is fully electric, which eliminates fumes from fuel and exhaust and significantly reduces noise during service appointments. Please make sure your lawn is clear of children’s toys, dog toys, garden tools, garden hoses, faulty or improperly installed irrigation heads, or any other obstacles that could get sucked into the blades of our mowers. Dog waste dirties our equipment, trailers, and employees and leaves an unpleasant smell. Please remove it before we arrive each week. Your monthly service fee will be charged on or around the date of your subscription and will continue until canceled. You may cancel anytime by contacting us via email. A reminder will be sent out at the end of the season that lawn care service will pause for the winter. Automatic payments will be paused during this time and will resume in the spring. A reminder will be sent before lawn care service resumes the following season. You may pause your lawn care service during the lawn care season by reaching out to us via email at least 2 business days before your next service appointment to avoid being charged.
Eco-friendly fertilizing and weed control:
We offer a 4- or 6-step fertilization program (depending on your grass type) that’s better for pets, people, and the planet and will keep your lawn looking its best all season long:
Warm-season grasses:
Step 1: Spring application of granular or liquid fertilizer (depends on size of treated area and product availability) to promote color and thicken turf to help prevent weeds.
Step 2: Early summer application of liquid fertilizer to promote color and thicken turf. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Step 3: Mid-summer application of liquid fertilizer to promote color and thicken turf. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Step 4: Late summer application of granular or liquid fertilizer to promote color, thicken grass, and prepare your lawn for winter. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Cool-season grasses:
Step 1: Early spring application of granular or liquid fertilizer (depends on size of treated area and product availability) to promote color and growth to help prevent weeds.
Step 2: Late spring application of fertilizer to promote color and thicken turf. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Step 3: Mid-summer application of liquid fertilizer to promote color and improve drought tolerance. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Step 4: Late summer application of granular or liquid fertilizer to promote color and growth to help prevent weeds. Liquid application of non-toxic post-emergent weed control sprayed as needed.
Step 5: Early fall application of liquid fertilizer to promote color and growth to help prevent weeds. Liquid application of non-toxic post-emergent weed control sprayed as needed.
Step 6: Late fall application of liquid fertilizer to promote color and prepare your lawn for winter. Liquid application of non-toxic, post-emergent weed control sprayed as needed.
Our fertilizer and weed control suppliers formulate their products with simple, non-toxic ingredients like seaweed, soy protein, and molasses. Liquid fertilizers reduce nutrient runoff and improve nutrient uptake. Access to exterior spigots may be required for liquid fertilizer application.
The cost of our seasonal fertilization and weed control program is totaled each year, divided by the number of months the program will be active, and added to your monthly payment beginning in the first month of application and ending in the last month of application.
Ant control:
Ant control service is included for free with our elite lawn care package and can be added to other packages for an additional $5 per 10,000sqft of treatment area per service. An organic granular bait is applied to any ant mounds we encounter during your service appointment.
Pruning:
Plants are pruned twice per year. This helps maintain healthy, attractive plants. Pruning is performed during mid-summer and late winter. Invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice.
Edible landscaping:
Edible landscaping receives two applications of compost per year (spring and fall) and 1-2 (depending on needs of plant) applications per growing season of an appropriate slow-release or liquid fertilizer.
Spring cleanups:
Spring cleanups include perennial trimming, leaf cleanup, and winter debris removal from your lawn and planting areas. Invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice.
Mulching:
Mulch enhances the appearance of your landscape, retains moisture in natural areas, improves your soil, and slows weed development. Our mulch spreading service is limited to natural mulches such as cedar and shredded hardwood because colored mulches often contain shredded pallets and other discarded construction materials that can leach harmful chemicals into your soil. To prevent soil compaction and turf damage, we do not spread mulch using heavy equipment. Invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice.
Hedge trimming:
Hedges are trimmed as needed depending on the growth rate of the plants. Invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice.
Fall cleanups:
Fall cleanups include perennial trimming and leaf cleanup during November and December. Leaves can be mulched to fertilize your lawn or removed from your lawn and placed in your planting beds. Invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice.
Auto-renew and cancellation:
Subscription service will renew automatically each season unless you contact us via email to cancel. A renewal letter or email will be sent in the spring (usually in January) detailing the upcoming season’s services and the monthly payment amount. If you wish to make changes or cancel your service, please notify us via email at least 7 days before services begin. Either party may cancel services at any time.
Payment and miscellaneous:
Recurring payments are processed on or around the date of your subscription each month. For one-time payments, invoices are sent at time of service and payment is expected within 14 days of receipt. If you subscribe to our eco-friendly lawn care service, the card on file will be charged the amount shown on the invoice. If you are unable to make a payment for any reason, please reach out as soon as possible. We will do everything we can to accommodate your situation. If we have not heard from you and payment has not been received within 14 days, your service will be paused until payment is made.
WARRANTY
LANDSCAPE WARRANTY
The plant material installed is warranted for a period of one (1) year from the date of installation (the “Warranty Period”). Subject to the following terms and conditions. This limited warranty does not relate to grading, seeding or settlement of subgrade. Seasonal flowers (perennial and annual) are not included in this warranty coverage.
Plant material covered by this limited warranty, which dies during the Warranty Period will be replaced with the plant material of like variety and original size, one time only, provided that the account is paid full per terms of the agreement. In order to insure the survival of replacement plant materials, replanting will be done only during appropriate planting seasons when weather conditions are favorable. The Warranty Period shall not be extended in the event that replacement plantings are required during the Warranty Period.
As a condition of this limited warranty, you are responsible to properly maintain the plant material during the Warranty Period. This limited warranty shall not cover the death of plant material caused by vandalism or uncontrollable acts of nature, which shall include but shall not be limited to, high winds, drought, fluids, ice, snow, and hurricane.

PLANT WATERING
Watering is the primary concern for newly installed plant material. The amount of water is critical. It is possible to over water plants and in fact can be detrimental to their condition. The key of watering trees and shrubs is to keep the root ball and surrounding soil moist but not soggy or saturated. The way to accomplish this is to apply water so the moisture soaks in rather than running off the surface.
SOD INSTALL
Guaranteed to root which takes approximately 2 weeks, as long as customer takes reasonable care in watering. New sod should be watered so root structure stays wet at all times. Watering times will vary based on weather conditions. Sod should be maintained as regular grass after 30 days which should include a regular maintenance program.
HARDSCAPE
Neighborhood Foodscapes & Lawn provides a 3 part warranty on all hardscape work.
WEEDS: 3 YEARS This warranty will cover weeds from growing in paver joints. This coverage is for a weed breakout, not for a handful of weeds. If Neighborhood Foodscapes & Lawn deems a failure has occurred, we will provide a one-time power washing and resanding over the 3 years. This warranty does not cover new germination from overseeding.
LABOR: 5 YEARS Brothers Landscaping stands behind our labor and craftsmanship for 5 years. If any problems occur over that time, we will inspect services performed and provide labor to repair problem areas. This warranty does not cover failures do to conditions outside the scope of the hardscape installation.
LIFETIME: This part of the warranty is provided by the manufacturer of the products installed. Neighborhood Foodscapes & Lawn provides no product warranty and consumers should check warranty specifications with manufacturers.
MAINTENANCE
Neighborhood Foodscapes & Lawn recommends cleaning hardscapes with a power washer ever 2 years or as needed. It is also suggested to resand paver joints every 3 years or as needed with sand.
WEATHER CONDITION CLAUSE FOR LAWN CARE PROGRAMS
We will keep you informed of any modifications to this schedule. The success of this program depends on proper watering, mowing and cultural practices.
CLEAN UP
A. Removal of fallen branches from the lawn and landscaped beds.
B. Trimming of perennial husks
LANDSCAPE PRUNING
All shrubs, bushes, and ornamental plantings will be pruned and shaped as appropriate for the plant species. Debris will be removed. Trees over 15' are not included in landscape pruning.
END OF SEASON
At the end of the season when leaves start to fall and lawns grow at a slower rate, Neighborhood Foodscapes & Lawn may vary the frequency of cutting. If a customer would like to ensure a particular cutting schedule, the customer must call to make the appropriate arrangements. If there is an overabundance of leaves, cleanup may be required before service can be performed. Lawn cleanup service is offered but not included in mowing packages. In towns that have leaf pickup, the leaves will be placed at the curb in a neat manner. In other towns removal of leaves may incur additional charges.
INSECT PROBLEMS
Total insect elimination is not desirable with any program because beneficial insects will be lost along with the targeted pests. Acceptable levels of activity and targeted applications combine to give enhanced plant aesthetics.
DISEASE PROBLEMS
Climactic conditions, types of disease and plant materials affected will impact response. Results for difficult-to-control diseases will vary depending on environment, culture and agronomic programs used. Treatments for disease may include additional cost.
PROPERTY DAMAGE
We are not responsible for any underground private utility damage that may occur (i.e. lighting, drainage, irrigation. etc.). Also, we will not be responsible for damage done to fences when grass is growing right up to fence and has to be trimmed with weed trimmer.
QUALITY GUARANTEE
IF YOU ARE NOT SATISFIED WITH THE RESULTS OF OUR SERVICE AND NOTIFY US WITHIN A REASONABLE TIME PERIOD WE WILL RETURN TO THE PROPERTY AND CORRECT THE PROBLEM FREE OF CHARGE. IF THE PROBLEM IS DUE TO A FERTILIZER OR PESTICIDE APPLICATION, WE WILL ANALYZE THE AREA AND MAKE SPECIFIC RECOMMENDATIONS TO REMEDY THE PROBLEM. WE WILL RETREAT THE AREA IF NECESSARY. APPLICATIONS WILL TAKE 10 TO 15 DAYS TO NOTICE RESULTS. NEIGHBORHOOD FOODSCAPES & LAWN RESERVES THE RIGHT TO PUT A SIGN ON THE PROPERTY FOR A MAXIMUM 2 WEEK PERIOD THAT WE WILL COME AND REMOVE.
STANDARD TERMS AND CONDITIONS
1. NEIGHBORHOOD FOODSCAPES & LAWN AGREES TO FURNISH LABOR AND MATERIALS AND IS AUTHORIZED BY YOU TO SERVICE THE PROPERTY AT THE ADDRESS SHOWN ON THE FRONT OF AGREEMENT ON YOUR BEHALF AND HAS THE AUTHORITY TO GRANT IN ACCORDANCE WITH THIS AGREEMENT.
2. NEIGHBORHOOD FOODSCAPES & LAWN IS NOT RESPONSIBLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OR RESULTING FROM THE PERFORMANCE OR NONPERFORMANCE OF ANY OBLIGATIONS UNDER THIS AGREEMENT.
3. ALL WARRANTIES WILL BE VOIDED IF SERVICES ARE NOT PAID IN FULL. AS AGREED, NO CASH VALUE IS IMPLIED FOR WARRANTY WORK.
4. A LATE FEE OF 5% PER MONTH WILL BE CHARGED ON ANY BALANCE UNPAID AFTER THIRTY (30) DAYS. A SERVICE CHARGE OF $35.00 WILL BE CHARGED FOR ANY RETURNED CHECKS. IF YOUR ACCOUNT BECOMES DELINQUENT, SERVICE WILL BE DELAYED UNTIL PAYMENT IS RENDERED AT WHICH TIME SERVICE WILL COMMENCE ACCORDING TO OUR DISCRETION. IN ADDITION WE HAVE THE RIGHT TO CANCEL SERVICES AT ANY TIME. SHOULD IT BECOME NECESSARY TO TAKE ACTION TO COLLECT PAYMENT DUE UNDER THIS AGREEMENT, THE CUSTOMER AGREES TO PAY ALL COSTS OF SUCH COLLECTION INCLUDING REASONABLE ATTORNEY’S FEES, COURT COLLECTION COSTS, AND/OR COLLECTING FEES (A MINIMUM OF $250.00).
5.IF ANY CONFLICTS EXISTS IN THIS AGREEMENT BETWEEN TERMS WHICH ARE PRINTED AND THOSE WHICH ARE TYPED OR WRITTEN. THE TYPED OR WRITTEN TERMS SHALL GOVERN.
6.THIS CONTRACT AGREEMENT WILL BECOME BINDING UPON SIGNING. ALL DEPOSITS ARE NON-REFUNDABLE.
